Webfast AI provides an AI-powered website builder that allows users to create, design, and manage websites using advanced artificial intelligence. The Platform enables users to build websites for personal, business, or other purposes, and offers various templates and customization options.

To use the Platform, you must create an account. By doing so, you agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for:

• Keeping your login credentials secure.
• All activities that occur under your account, whether or not authorized by you.
• Immediately notifying Webfast AI of any unauthorized use of your account.

Webfast AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for the purpose of creating and managing your website. You agree not to:

• Copy, modify, distribute, or reverse-engineer any part of the Platform.
• Use the Platform for unlawful activities, including but not limited to infringing intellectual property rights, transmitting viruses, or engaging in illegal actions.

• Ownership of Content: You retain ownership of all content that you upload or create using the Platform ("User Content"). However, by using the Platform, you grant Webfast AI a license to use, store, and process the User Content for the purpose of providing and improving the Platform.
• Privacy and Data Usage: Webfast AI will process your personal data in accordance with its privacy policy, which you agree to by using the Platform. You are responsible for complying with any applicable privacy regulations, especially when uploading content that may involve third-party data.

You agree not to:

• Use the Platform in any manner that could disrupt, damage, or impair the proper functioning of the Platform or interfere with other users’ experience.
• Upload, distribute, or transmit any viruses, malware, or other malicious code.
• Use the Platform for illegal activities, including, but not limited to, infringing on the intellectual property rights of others, defamation, or harassment.

Some features of the Platform may require payment. If applicable, you agree to pay all fees associated with the services you use. Payment terms, subscription fees, and billing cycles will be specified on the Platform. All payments are non-refundable unless otherwise stated.

• Platform Ownership: The Platform, including all its features, content, and intellectual property rights, is owned by Webfast AI or its licensors. You do not acquire any ownership rights to the Platform by using it.

• User Content: You retain ownership of the User Content you upload or create, but you grant Webfast AI a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute such content to provide and improve the Platform.

The Platform may contain links to third-party websites or services that are not owned or controlled by Webfast AI. Webfast AI is not responsible for the availability or accuracy of these external services, and you agree to use them at your own risk, subject to their respective terms of service.

• Suspension or Termination: Webfast AI reserves the right to suspend or terminate your access to the Platform if you violate these Terms of Service. If your account is terminated, you will lose access to the Platform and all content associated with your account may be permanently deleted, subject to applicable data retention laws.

• Effect of Termination: Upon termination, your rights to use the Platform will cease, and you must immediately stop using the Platform.

• No Warranty: The Platform is provided "as is" without any warranties of any kind. Webfast AI makes no representations or warranties regarding the reliability, accuracy, or suitability of the Platform for your needs.
• Limitation of Liability: To the maximum extent permitted by law, Webfast AI's liability for any damages arising out of this Agreement is limited to the amount you have paid for the Platform during the last six (6) months. In no event will Webfast AI be liable for any indirect, incidental, special, or consequential damages.
• Indemnification: You agree to indemnify and hold harmless Webfast AI and its affiliates from any claims, damages, or losses arising from your use of the Platform or violation of these Terms of Service.

Webfast AI reserves the right to update or modify these Terms of Service at any time. The changes will be communicated via email or on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the updated terms.

• Entire Agreement: This Agreement constitutes the entire understanding between you and Webfast AI with respect to the use of the Platform.
• Severability: If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Assignment: You may not assign or transfer your rights or obligations under this Agreement without the prior written consent of Webfast AI.

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
